Terms & Conditions — OuiSi Photologue
These terms are an agreement between you and OuiSi Inc. ("OuiSi," "we") covering your use of the OuiSi Photologue iPhone app. By using the app, you agree to them.
1. Who can use OuiSi
You must be at least 17 years old. The app is not directed at children.
2. Beta software
OuiSi is currently in beta testing. It will have bugs, features will change, and Photologues, photos, or comments may occasionally be lost. Please don't put anything in one you can't afford to lose.
3. Your content
- You own the photos and comments you add. They stay yours. By adding them to a Photologue you give OuiSi the limited license needed to store them and show them to the players in that Photologue — nothing more. We store them in our own iCloud database, which means we are able to open them; we do so only to run and repair the app. We never sell them, license them onward, analyze them, or train anything on them.
- Only add content you have the right to share.
- Content you add to a Photologue is visible to everyone in it, including people who join later by invite link.
4. Acceptable use
Don't use OuiSi to share content that is unlawful, infringing, harassing, hateful, sexually explicit, or that exploits or endangers anyone. Don't attempt to disrupt the service or access other players' data. We may remove content or suspend accounts that violate these rules.
5. Invite links
Anyone with a Photologue's invite link and the app can join it. You're responsible for who you share your links with.
6. The service
We may modify, suspend, or discontinue the app (or any Photologue or feature) at any time, including deleting inactive data during the beta period. The app is provided "as is" and "as available," without warranties of any kind.
7. Limitation of liability
To the maximum extent permitted by law, OuiSi Inc. is not liable for indirect, incidental, or consequential damages arising from your use of the app, and our total liability for any claim is limited to $50.
8. Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
